Scope of application
We respect your right to privacy. The protection and security of your personal data are important to us. We would like to inform you in the data protection declaration which data is collected from you and processed as well as on which legal basis the data processing takes place. Your data is processed on the basis of the statutory provisions.
Data collection
If you contact us by e-mail or telephone, the data you provide will be stored by us for six months for the purpose of processing the enquiry / booking and in case of follow-up questions. We do not pass this on without your consent. We process the personal data that you provide to us as a customer when commissioning us to fulfil the contract. This includes for example: Name, date of birth, company wording, VAT number, address/delivery address, telephone number (mobile phone number), email addresses, data from official photo IDs. In addition, we process data about the nature and fulfilment of your contractual relationship. We will only pass on or transmit this data to third parties if this is necessary for the purpose of processing the contract or for billing purposes or if you have given your prior consent.
Data processing
We process your personal data and the data about your contractual relationship for the provision of the agreed delivery or other agreed service (purpose of processing). The processing of this data is necessary for the conclusion of the contract and for the execution of the contract. The processing is permissible according to Art 6 (1) (b) of the General Data Protection Regulation. If you have given us the corresponding consent, we will use your personal data after the termination of our contractual relationship to send you information about our services (e.g. via a newsletter).
Cookies
Our website uses so-called "cookies". These are small text files that are stored on your end device with the help of the browser. A cookie contains information that is sent from the website to your browser. The browser then stores the information on its system. When cookies are used, the website can remember information about you and its settings. This occurs either until you close the current browser window or the cookie is deactivated or deleted.
Our website uses functions of the web analysis service Google Analytics. Google Analytics uses cookies. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. As far as we are aware, Google will use this information for the sole purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. Google may transfer this information to third parties where required to do so by law. The contractual relationship with Google Analytics is based on standard contractual clauses of the European Commission. The data processing is carried out on the basis of the legal provision of § 96 para 3 TKG and § 6 para 1 lit f DSGVO. Our legitimate interest is the improvement of our offer and our website.
Marketing
We collect, process and use your data for the purposes of advertising and/or market and opinion research. The data processing is based on § 6 para 1 lit f DSGVO. The use of data for market and opinion research takes place in anonymised form. Our legitimate interest lies in the information about our services and in the analysis of our offer.
Data security
We strive to protect your data in accordance with current security standards. To this end, authorised individuals may have reasonable access to the stored data in order to verify, correct, anonymise, block or delete such data. Please be aware that any information you voluntarily disclose over the Internet is potentially subject to interception. For this reason, we cannot accept any responsibility or liability for the disclosure of information due to errors in data transmission and/or unauthorised access by third parties.
Deletion
As a matter of principle, we delete your data after termination of the contractual relationship, at the latest, however, after expiry of all statutory retention obligations. There is the possibility that instead of deletion, anonymisation of the data is carried out. In this case, any personal reference to the data is irrevocably removed, which is why there is no deletion obligation under data protection law.
Your rights
Right to information: You can request confirmation from us as to whether and to what extent we process your data.
Right of rectification:
If we process your personal data that is incomplete or incorrect, you can request that it be corrected or completed at any time.
Right to erasure:
You can demand that we delete your personal data if we process it unlawfully or if the processing disproportionately interferes with your legitimate interests in protection. There may be reasons that prevent immediate deletion (such as legally regulated retention obligations).
Right to restriction of processing:
You can request us to restrict the processing of your data if
- you dispute the accuracy of the data for a period of time that allows us to verify the accuracy of the data,
- the processing of the data is unlawful, but you refuse erasure and instead request restriction of the use of the data,
- we no longer need the data for the intended purpose, but you still need this data to assert or defend legal claims,
- you have objected to the processing of the data.
Right to data portability:
You can request that we provide you with the data you have entrusted us with for storage in a structured, common and machine-readable format.
Right to object:
If we process data for the performance of tasks in the public interest, for the exercise of official authority or if we rely on the necessity of the processing to protect our legitimate interest, you can object to this data processing. The objection is justified if you have a legitimate interest in protecting your data.
Right of appeal:
If you believe that we are violating data protection law when processing your data, please contact us. Of course, you also have the option of complaining to the Austrian data protection authority, and from 25 May 2018 also to the supervisory authority within the EU. If you wish to assert your rights against us, simply use our email address team@fanvan.at.
If we have doubts about your identity, we may request additional information. Please note that we may charge a reasonable processing fee or refuse to process your request if your rights are manifestly unfounded or are exercised particularly frequently.
